COMPLETE MEMBERSHIP CONDITIONS & RULES OF USEAGE

MEMBERSHIP CONDITIONS:
1: Ownership- The Picture of Health Club is a
proprietary club owned by Queensferry Hotels Ltd (“the Owners”). The Leisure
Club at Best Western Plus Keavil House Hotel is administered by Management of
their nominees.
2: Application- Applicants must complete the
official form, provide two passport photographs, and submit a fully completed
Direct Debit Instruction.
3: Right of Refusal- The Owners reserve the right to reject any application
without statement of cause, in which case any membership fees will be refunded
immediately.
4: Membership is strictly non-transferable
5: Payment Structure- Membership is a rolling monthly contract. Fees are payable
monthly in advance via Direct Debit
6: Subscription Variation- The owners determine all subscriptions and charges. Members
will be notified of any changes via a Renewal Reminder at least 10 working days
in advance (per DMCC Act
2024).
7: Joint membership- Eligibility is restricted to two persons residing the same
address.
8: Cancellation (“Easy Exit”)- In accordance with the DMCC Act 2024, members may cancel via the same method used to join (eg. online portal or
email).
Notice- Must be given by the 15th of the month to end
at the month’s close
Cooling-off- All new members include a 14-day
statutory cooling-off period.
9: Guests- Limited to two guests per day. No
guest may be introduced more than twice per month. Members are responsible for
their guest’ behaviour and any unpaid guest accounts.
10: Operating Hours- The Owners may vary opening times or temporarily close
facilities for repair/maintenance without notice or refund of membership fees.
11: Supervison & Liability- Supervison of every facility is not possible at all times.
The Owners accept no liability for any accident, injury, or loss for property,
except where required by law.
12: Physical capability- The owners are not responsible
for any harm resulting from activities beyond a member’s physical capability.
Members must ensure their health is not to involve risk to themselves or
others.
13: Termination for Misconduct- Misuse of facilities, safety hazards, or interference with
the enjoyment of other will result in immediate termination. For joint
memberships, the termination of one person automatically terminates all other
on that membership.
14: Address changes- Members must inform management of any changes to postal or
email addresses.
15: Data protection (Data Act 2025)- The Club processes personal and health-related data in
accordance with the Data (Use and
Access) Act 2025. Data is used strictly for
contract performances and safety administration. Members have the statutory
right to access or request deletion of their records.
16: Direct Debit Guarantee- All payments are protected by the Direct Debit Guarentee. If
an error is made by the Club or your bank, you are guaranteed a full and
immediate refund.
RULES OF USEAGE
1: Guest Registration- All guests must be accompanied by a member and must sign the
visitors book.
2: Alcohol & Substances- Use of facilities under the influence of alcohol or drugs is
strictly prohibited.
3: Entry- Entry is only permitted signing
in.
4: Gambling- No part of the club shall be used
for gambling or games of chance.
5: Hygiene- Members and guests must shower
before using the pool, sauna, steam room or Jacuzzi.
6: Dress code- Proper athletic apparel and
clean, indoor-only training shoes are required in the gym. Admission may be
refused for improper dress.
7: Pets- No pets are allowed, with the
exception of guide dogs.
8: Smoking- Smoking and “vaping”
(e-cigarettes) are strictly prohibited throughout the club.
9: Age Restrictions & Safety (2026 Protocol)
Gymnasium & free weights- Strictly
prohibited for anyone under the age of 16. Access is reserved for members aged
16 and over.
Sauna, Steam room & Jacuzzi- Strictly reserved for members aged 18 and over.
Swimming pool (Under 16s)- All persons under the age of 16 must be accompanied in the water and supervised by a
responsible adult (18+) at all times (Max 1:2 ratio)
Junior Access Hours- Under 16s
are permitted in the pool between 9:30am and 8:00pm.
Youth Induction- Members aged 16-17 may use the club (excluding heat rooms) between 8:00am and 8:00pm following a mandatory Safety Induction.
Sunbeds-
Instructions for sunbed use must be strictly followed, no under 18s, and goggles must be worn.
Pool Safety- No running, jumping, or diving in
the pool area.
Mixed facilities- The sauna and steam room are mixed; appropriate swimwear
must be worn at all times.
Digital Privacy (Data Act 2025)- Use of devices with cameras is strictly prohibited in
changing rooms and the pool area. In the Gymnasium, filming/blogging that
captures others without consent is a breach of rules and may result in
membership termination.
Health Status- Members with a history of heart
disease, high/low blood pressure, or diabetes must consult a doctor and provide
confirmation of fitness before using facilities.
Properly- Locker keys remain Club property
and must not leave the premises. Lost property will be disposed of after one
month.
